Terms of Service

1. Acceptance of these Terms

By accessing or using the Service, you confirm that you can form a binding contract with us and that you accept these Terms. If you are using the Service on behalf of a minor or an organization, you represent that you have authority to bind that person or entity to these Terms.

2. Definitions

• "Student" — a user who receives tutoring through the Service.
• "Tutor" — a user who provides tutoring through the Service.
• "Parent/Guardian" — the adult responsible for a Student under 18.
• "Administrator" — an iTutorzz staff member who manages accounts, scheduling, and support.
• "Content" — messages, files, lesson notes, and any other material submitted through the Service.

3. Eligibility & accounts

You may use the Service only if you can legally enter into these Terms. Account rules by age:

• Adults (18+) may register and manage their own account.
• Minors (under 18) may use the Service only through an account created, approved, and supervised by a Parent/Guardian (or an Administrator acting with parental permission). The responsible adult is bound by these Terms and is responsible for the minor's use of the Service.

You agree to provide accurate, current, and complete information and to keep it up to date. We may refuse, suspend, or terminate accounts at our discretion, including for inaccurate information or violations of these Terms.

4. Parental / guardian responsibility

If you create or approve an account for a minor, you confirm that you are the minor's Parent/Guardian or have obtained the Parent/Guardian's consent, and you consent to the collection and use of the minor's information as described in our Privacy Policy. You are responsible for supervising the minor's use of the Service, including their lessons, messages, and interactions with Tutors, and for all activity that occurs under the account.

5. The Service

iTutorzz provides a platform to schedule and manage tutoring lessons, attend live virtual classrooms, exchange messages and files between matched Tutors and Students, track attendance and makeup credits, and (for Tutors) view earnings. We act as a platform that facilitates these interactions. We do not guarantee any particular educational result, grade, score, or outcome.

6. Account security

You are responsible for safeguarding your login credentials and for all activity under your account. Do not share your password. Notify us immediately at info@itutorzz.com if you suspect unauthorized access. We are not liable for losses arising from your failure to protect your credentials.

7. Acceptable use

You agree not to, and not to permit anyone else to:

• Use the Service for any unlawful, harmful, fraudulent, or abusive purpose;
• Harass, threaten, bully, or harm any other user, including any Student or Tutor;
• Upload or share content that is illegal, obscene, defamatory, infringing, or otherwise objectionable, or that is inappropriate for an educational platform used by minors;
• Attempt to contact, solicit, or arrange payments with another user outside the Service in order to circumvent it, where prohibited by your agreement with us;
• Impersonate any person or misrepresent your affiliation;
• Upload viruses or malicious code, or interfere with or disrupt the Service or its security;
• Probe, scan, scrape, reverse-engineer, or attempt to gain unauthorized access to the Service or its systems;
• Use the Service to send spam or unauthorized advertising;
• Record a live class or capture another user's image, audio, or messages without their (or, for a minor, their Parent/Guardian's) consent and as permitted by law.

We may investigate and take appropriate action, including removing content and suspending or terminating accounts, for any violation.

8. Lessons, scheduling & attendance

• Scheduling. Lessons are scheduled by Administrators or arranged between Tutors and Students through lesson proposals. A proposal becomes a booked lesson when accepted.
• Attendance & notes. Tutors and Administrators record attendance and lesson notes. These records are used for tracking progress, billing, and makeup credits.
• Makeup credits. Where a lesson is missed under the conditions we apply, a makeup credit may be granted and later used to schedule a replacement lesson. Makeup credits have no cash value and are governed by our then-current policies.
• Cancellations & no-shows. Cancellation, rescheduling, and no-show outcomes (including any effect on credits or tutor compensation) are handled according to our operating policies communicated to you.
• Live classroom. Live classes run through a third-party video provider (Agora). Access is time-bound to the scheduled lesson window.

9. Payments, invoices & refunds

• Student/Parent payments. Tuition is billed by invoice and paid through PayPal. Payment is due as stated on each invoice. We do not process or store full payment-card or bank-account numbers; payment is handled by PayPal under its own terms.
• No in-app purchases. The Service does not currently charge through in-app billing or app-store subscriptions.
• Tutor payouts. Tutor earnings shown in the Service are informational. Actual payouts are made outside the Service (for example, by bank transfer) according to the arrangement between iTutorzz and the Tutor. Bank/payout details are collected and handled outside the application.
• Taxes. You are responsible for any taxes applicable to your use of the Service or, for Tutors, to your earnings, except taxes on our net income.
• Refunds. Refunds, where offered, are handled according to our then-current refund policy and applicable law. Contact info@itutorzz.com with billing questions.

10. Your content

You retain ownership of the Content you submit. You grant iTutorzz a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process your Content solely as needed to operate, secure, and provide the Service (for example, delivering a message to its recipient or storing a lesson note). You are responsible for your Content and represent that you have the rights to submit it and that it does not violate these Terms or any law. We may remove Content that violates these Terms or that we believe is harmful or unlawful.

11. Intellectual property

The Service, including its software, design, text, graphics, logos, and trademarks (including "iTutorzz"), is owned by iTutorzz LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service except as expressly permitted.

12. Third-party services

The Service integrates third-party services, including Agora (live classroom), Google/Firebase and Expo (notifications), Google (optional calendar sync), and PayPal (payments). Your use of those features may be subject to the third party's own terms and privacy policies. We are not responsible for third-party services and do not control them.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it, including the children's-privacy section, before using the Service.

14. Suspension & termination

You may stop using the Service and request account deletion at any time via our data-deletion page. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or to protect the Service or its users. Upon termination, your right to use the Service ceases; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY EDUCATIONAL OUTCOME WILL BE ACHIEVED. ANY ARRANGEMENT BETWEEN A STUDENT AND A TUTOR IS BETWEEN THOSE PARTIES, AND WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ITUTORZZ LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

17. Indemnification

You agree to indemnify and hold harmless iTutorzz LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party. For a minor's account, the responsible Parent/Guardian accepts this obligation.

18. Governing law & disputes

These Terms are governed by the laws of the State of Montana, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Montana, USA, unless applicable law in your place of residence requires otherwise. Nothing in this section deprives a consumer of the protection of mandatory laws of their home jurisdiction.

19. Changes to the Service & Terms

We may modify or discontinue the Service (in whole or in part) at any time. We may also update these Terms; when changes are material, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

20. Miscellaneous

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce any right or provision is not a waiver of it.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
• Notices. We may provide notices to you by email, in-app message, or posting on the Service.
